Terms and conditions apply, on the one hand, to Fact and Matter, registered in the Handelsregister with KvK-number 77429567, VAT-number NL003193023B86 and residing on the address Admiraal de Ruijterweg 286-1, 1055 MS, Amsterdam, The Netherlands, and, on the other, to the person/people whom acquire through our website any product/service.
Fact and Matter reserves the right to revise and modify the hereby conditions at any moment, therefore the buyer must always read them before placing an order.

3. Prices and Information
All prices mentioned on our website include tax as well as any government levies, unless otherwise stated. The actual shipping costs within and outside of the Netherlands can be found on the shipping page of our website. The amount of shipping costs will be displayed in the order process in the shopping basket screen.

Although the content our website is selected with due care, we cannot guarantee that all information on the webshop is at all times correct and complete. All prices and other information are subject to obvious programming errors and typos. We can not give a 100% guarantee that the colours of the products on the webshop match the exact colours of the product itself.
 
4. The order
The order is concluded at the moment you accept the offer of Fact and Matter, which is the moment on which you complete the order process. We will confirm the receipt of the order by e-mail or via another digital way.

5. Payment
You may only use the payment methods specified in the order process. Fact and Matter is free in its choice of payment methods offered on our website. These payment methods may change from time to time.
The website states that the card holders are responsible of their transactions. In order to provide maximum security to the payment process factandmatter.com uses SSL secure payment system with encrypted data. By using this site, you consent that you have the minimum legal age to purchase online in your state or province of residence.

6. Implementation of the order
As soon as we have received the order, we will send the ordered product to you as soon as possible. Ordered items will be shipped in principle within 1-5 working days. In the event that we are unable to ship the ordered products within the term indicated above, we will inform the customer thereof. In that event you may either accept a new delivery date, or terminate the agreement free of charge.

You must inspect the products immediately upon receipt. In the event of any defects, you must notify Fact and Matter in writing within three days, preferably accompanied a digital photograph. See also Article 8 (Warranty and conformity). Once the items have been delivered to the specified delivery address, the risk is transferred to the you.

7. Right of withdrawal / return option
In order to change a product: you have 14 days from the date of arrival of your purchase. To proceed, please always notify us at info@factandmatter.com indicating the product you wish to change and the reason why you want to change it. Any change will only be accepted when the item is in perfect conditions with its original packaging. Please send the products you want to change to the address below:

We recommend you to send the package with tracking number to avoid any lost in the transit. Any exchange for another  item will generate new shipping costs that will be at your charge.

8. Refund
Fact and Matter will reimburse the purchase price to you as soon as possible but no later than 14 days after receipt of the returned items. Fact and Matter will use the same payment method as the method used by in the ordering process. The shipping costs of the return shipment are borne by the customer.

9. Warranty; complaints
Fact and Matter guarantees that all products offered meet the specifications stated in the offer, the reasonable requirements of quality and usefulness, and that they meet legal provisions and government regulations in force on the date of the conclusion of the Agreement. Should you have a complaint about a product and/or about other aspects of our service, please submit such a complaint to us by e-mail. We strive to respond to any such complaint as soon as possible, but in any event within 30 days of receipt of the complaint. You can also submit a complaint via the EU dispute settlement platform, accessible via https://webgate.ec.europa.eu/odr/.

10. Privacy policy
Fact and Matter processes the personal data of the Customer in accordance with privacy policy published our website. The privacy policy can be accessed via our website.

 11. Further Provisions
The order and terms are governed by Dutch law. Unless provided otherwise by mandatory law, any disputes that may arise will be submitted to the competent Dutch court in the district of Amsterdam. In this order, “in writing” includes communication by e-mail, provided that the identity of the sender is sufficiently clear.
 
12. Retention of title and liability
As long as no full payment of the purchased items has been made for the entire agreed amount, all delivered goods remain the property of Fact and Matter. The aggregate liability of Fact and Matter to Customer for breach of the order is limited to the aggregate price (including VAT) of the goods ordered, unless the damage is caused by wilful intent or gross negligence of Fact and Matter. Liability of Fact and Matter towards you for any indirect damage, including consequential damages, lost profits, lost savings, loss of data and/or loss due to business interruption is excluded at all times. Except for the limited liability as described in the preceding paragraphs of this article, Fact and Matter accepts no liability whatsoever to you. No obligation to pay any form of compensation is accepted unless the you report the alleged damage as soon as possible but no later than 30 days after the occurrence thereof in writing to Fact and Matter. In the event of force majeure, we cannot be held liable for any damage.
